Margarita's Mexican Restaurant Closure Leaves Woodward Property in Limbo

Berkley officials say it is unclear who will take responsibility for the vacant site.

in Berkley has closed its doors and city officials say the eatery's future remains uncertain.

A notice on the Woodward Avenue restaurant's front door says the building has been deemed vacant and that if it remains so as of Nov. 30, it must be registered and inspected.

"We've got no info on any new business or where (owner Luis Gomez) went," Berkley Building Official Duaine Franks said.

Gomez could not be reached for comment.

Multiple U.S. Postal Service delivery notices are strewn about the property and a demolition appears under way inside the building. Dumpsters out back are filled with what appear to be pieces of the restaurant's interior.

Berkley City Planner Amy Vansen said it's possible the property will be in limbo for a period of time.

A redemption period is common for tenants of business properties such as Margarita's: If the owner takes the proper steps he or she may be able to keep the property, Vansen said. If the owner does not intend to do so, neither the owner nor the bank is likely to identify themself as the responsible party during that time, Vansen said.

However, if the building remains vacant as of Nov. 30, "the bank or whomever is going to purchase it will likely register and pay $200 (as required)," Vansen said. "The city will schedule an inspection and identify needed repairs."

The city must receive a notarized letter from any intended purchaser saying the repairs have been identified, she said.

While Vansen said she is unaware of any potential buyers, she expressed confidence that the building will be registered as required.

"Since this is the new normal – it used to be more of a scramble – banks are aware that most communities have a vacant property registry," she said.

The popular restaurant's closure is a loss not only for diners, but also for Berkley's business landscape.
